She has mental and physical health vulnerabilities, including asthma. The resident raised a complaint to the landlord on 13 March 2024 saying that it was not communicating or acting to resolve the issues. Following the complaint, the landlord sent its damp and mould contractor who identified remedial repairs.
The resident was concerned that the contractor did not intend to replace the wallpaper after a mould wash, and she escalated her complaint to stage 2. In its stage 2 complaint response, the landlord told the resident that no further damp and mould works would be carried out because the resident’s property was on a retrofit programme for planned works. Reasons We cannot investigate issues which are also subject to legal proceedings or where matters at court are connected so closely to the complaint, they cannot be separated. In this case, we can see legal proceedings were issued at court on 2 September 2025. The matters at court relate to damp and mould and the landlord’s handling of related repairs in the property. These are the same issues that were brought to us to investigate and include events that the resident referred to in her complaint.
That means we have no power to investigate the complaint.
